1. Overview and Purpose

This Refund Policy ("Policy") describes when refunds may be provided for purchases made on Skivyy.com ("Skivyy", "we", "us"). Our offerings include: Certification tests, Pro subscriptions, Employer Curated Match, Full Database Access, and Job Postings. This Policy is designed to be fair and protective of platform integrity, while complying with applicable laws.

Except as expressly provided below or required by law, all purchases are final and non-refundable. Where refunds are permitted, they may be provided as original payment reversals or as Skivyy credits at our discretion.

2. Key Definitions

  • Refund: A reversal of charges to the original payment method or a credit applied to your Skivyy account.
  • Accessed: Viewing full candidate profiles, downloading resumes/data, exporting candidate lists, or initiating outreach via the platform.
  • Unique Candidate: A distinct candidate profile identified by a unique internal ID.
  • Booking: Selecting and confirming a specific date/time slot for a certification test.
  • Calendar Day: All refund windows are measured in Coordinated Universal Time (UTC) unless stated otherwise.

3. General Refund Terms

  • • Refund requests must be initiated by the account holder via [email protected] and include order ID, purchase date, product, and reason.
  • • We may require corroborating evidence (e.g., screenshots, error logs) and will verify usage against our telemetry.
  • • Chargebacks or payment disputes may trigger account suspension; we may contest disputes and pass associated fees.
  • • Multiple refunds or suspected abuse may lead to denial of future refunds, credits only, or account closure.
  • • Processing times: approved refunds typically within 5–10 business days; bank timelines may vary.
  • • Refunds cannot exceed the original amount paid; currency conversion, bank fees, and taxes may be non-refundable.
  • • We may issue refunds as Skivyy credits instead of cash in our discretion where permitted by law.
  • • Promotional codes, gift codes, and bonuses are non-refundable and have no cash value.

4. Certification Tests

Non-Refundable After Booking

  • • Certification purchases are generally non-refundable.
  • • Exception: a full refund may be requested only if you have not booked a test time/slot.
  • • Once a test time has been booked, the purchase becomes non-refundable under normal circumstances.

Rescheduling and No-Shows

  • • You may request to reschedule a booked test for a later date/time subject to availability.
  • • No-shows or late arrivals may be treated as test forfeits and remain non-refundable.
  • • Verified technical issues on our side may result in a complimentary reschedule rather than a refund.
  • • We may allow one complimentary reschedule; additional reschedules may incur fees.

Integrity and Misconduct

  • • Tests impacted by cheating, identity fraud, or policy violations are ineligible for refunds.
  • • We may suspend or revoke certifications for integrity breaches without refund.

No Employment Guarantee

Certification outcomes do not guarantee employment, interviews, or project awards; employers decide hiring.

System Outages and Force Majeure

  • • For platform outages or proctoring failures attributable to Skivyy, the remedy is a reschedule or test credit.
  • • Events outside our control (force majeure) do not create refund eligibility; we will offer reasonable rescheduling.

5. Pro Subscription

7-Day Money-Back Window

  • • Pro subscriptions are refundable within seven (7) days of purchase.
  • • After seven (7) days, cancellations stop future billing but the current month remains fully chargeable and non-refundable.
  • • Renewals and upgrades/downgrades after the initial 7 days are non-refundable unless required by law.

No Outcome Guarantee

Pro increases visibility and access but does not guarantee interviews, project awards, or employment.

Billing and Trials

  • • Cancellations take effect at the end of the current billing cycle.
  • • Free trials (if offered) convert to paid unless canceled before trial end; trial charges are non-refundable once converted.
  • • We do not provide proration for partial months unless required by law.

6. Employer Curated Match

24-Hour Refund if Unused

  • • Refunds are available within 24 hours of purchase only if our tools have not been used to access candidate data.
  • • "Use" includes viewing full candidate profiles, downloading resumes, exporting data, or sending outreach emails via the platform.
  • • System telemetry determines usage and timestamps (UTC); self-reporting is not sufficient.

7. Full Database Access

Eligibility Threshold

  • • A full refund may be granted only if fewer than 100 unique candidates have been accessed.
  • • "Accessed" means any of: full profile views, resume downloads, data exports, or platform emails initiated.
  • • If 100 or more unique candidates have been accessed, no refund is available.
  • • Unique candidates are counted by internal IDs; repeated access to the same candidate counts once.

8. Employer Job Postings

Posting Fees

  • • If a posting is cancelled before going live (publication), a refund may be granted.
  • • Once a job is published or promoted, fees are non-refundable.
  • • Posts removed for policy violations are not eligible for refunds.
  • • If removal was due solely to our error, we may refund or credit at our discretion.
  • • Edits or delays during moderation do not constitute grounds for a refund.
  • • Duplicate postings and miscategorized postings may be removed without refund.

9. How to Request a Refund

  • • Include: account email, order ID, purchase date, product, and justification.
  • • We typically respond within 3–5 business days with next steps.

10. Disputes, Abuse, and Exceptions

  • • We may deny refunds where fraud, abuse, or policy violations are suspected.
  • • Chargebacks will be contested; associated fees may be charged back to the account.
  • • Where required by law, statutory rights override this Policy.

11. Additional Policies and Edge Cases

Taxes, Fees, and Currency

  • • Bank, gateway, and currency conversion fees are typically non-refundable.
  • • VAT/GST and sales taxes are handled per jurisdictional rules; refunds may exclude non-reclaimable taxes.
  • • Refunds are processed in the original transaction currency when feasible.

Bundles, Promotions, and Credits

  • • Discounted bundles are refundable only according to each component’s eligibility; partial refunds are net of discounts.
  • • Promotional codes and bonus credits have no cash value and are non-refundable.
  • • Credits may expire; expiration will be disclosed at issuance.

Fraud Prevention and Audit

  • • We may audit account activity and request cooperation to verify eligibility.
  • • Refusal to cooperate or evidence of manipulation voids refund eligibility.

Third-Party Marketplaces

  • • Purchases made via third-party marketplaces or resellers must follow their refund policies.
  • • We cannot approve refunds for third-party transactions.

Minors and Unauthorized Purchases

  • • Accounts must be held by adults; parents/guardians are responsible for minors’ access.
  • • Unauthorized purchases are subject to our verification; refunds are not guaranteed.

System Outages and Force Majeure

  • • Remedies for outages are limited to rescheduling, replacement access, or credits at our discretion.
  • • No refunds for delays or failures caused by events beyond our reasonable control.

Governing Law and Consumer Rights

  • • This Policy is governed by the laws of British Columbia, Canada.
  • • Mandatory consumer rights under applicable law will be honored where they cannot be waived.

12. Changes to this Policy

We may update this Policy from time to time. Material changes will be communicated via email or platform notices. Continued use of the Platform after changes constitutes acceptance.
